These terms apply to your use of twinnpeak.com (the “Marketplace”), operated by TwinnPeak Medical (“TwinnPeak”, “we”, “us”) from Melbourne, Australia. By browsing the Marketplace, creating an account or listing equipment, you agree to these terms.
1. What the Marketplace is
TwinnPeak is an online marketplace. Independent vendors list new, used and refurbished medical equipment, and buyers contact or buy from them. Unless a listing says otherwise, each sale is a contract between the buyer and the vendor. We do not own, inspect or guarantee the equipment listed.
2. Accounts
- Give accurate details and keep them up to date.
- Keep your password secure. You are responsible for activity on your account.
- We may suspend or remove accounts that are fake, automated, misleading or in breach of these terms.
3. Vendor responsibilities
- Describe each item accurately, including its condition, model, specifications, location and price.
- Only list equipment you have the right to sell.
- Comply with all laws that apply to the sale, including medical device rules (such as TGA requirements in Australia) and the import and export rules of the buyer’s country.
- Do not list stolen, counterfeit or recalled items, medicines, or anything the law does not allow you to sell.
- Respond to enquiries honestly and deliver what you sell.
4. Buyer responsibilities
Before you buy, check that the equipment suits your purpose, that you are permitted to buy and use it, and that it meets the regulatory requirements where it will be used. Ask the vendor questions and arrange inspection, testing and servicing where appropriate.
5. Payments and fees
Some purchases are paid through third party processors such as Stripe or PayPal, and their terms also apply. We do not store full card details. Listing on the Marketplace is currently free. We will give notice before introducing any fees.
6. Listing content
Vendors keep ownership of their photos and descriptions, and allow us to display them on the Marketplace and in its promotion. Do not upload content you do not have the right to use.
7. Acceptable use
Do not send spam, create accounts automatically, scrape the site, try to get around its security, or use it for anything unlawful or misleading.
8. Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Otherwise, to the extent the law allows, the Marketplace is provided “as is”, and we are not liable for listings, the equipment sold, or dealings between buyers and vendors.
9. Changes
We may update these terms from time to time. The date at the top shows the latest version. Continuing to use the Marketplace means you accept the updated terms.
10. Governing law
These terms are governed by the laws of Victoria, Australia.
